Legal Notice, Terms & Conditions, and Privacy Policy

This page covers three documents that together govern the use of Plantsound: the legal notice, the general terms and conditions of sale and use, and the privacy and cookie policy.

Version 1.0, last updated 6 September 2026. Applicable to Plantsound and to the website plantsound.fr.

2. General Terms and Conditions of Sale and Use

Article 1. Definitions

Article 2. Purpose and nature of the service

Plantsound is a digital creative tool. It analyses, through the device camera, the micro-movements of a plant placed in front of the lens, identifies the botanical family by means of a recognition model that runs locally on the device, and generates a musical sequence in real time from that signal.

Nature of the service: please read

Plantsound is neither a medical device, nor a measuring instrument in the metrological sense, nor a scientific analysis tool. It makes no diagnosis, of a plant or of anything else, and treats nothing. It does not assess the health, needs or condition of a plant, and no decision concerning the care of a plant, a crop or a person should be based on it.

Plantsound is an applied bioacoustics and creative listening experience. The names given to certain settings (including the "healing" scale and the reference frequencies labelled "emotional", "water" and "earth") are traditional or conventional designations in common use in the wellness field. They describe a musical choice; they are not, and must not be read as, any claim of physiological, therapeutic or health effect.

Article 3. Acceptance

Purchasing access to Plantsound constitutes unconditional acceptance of these terms and conditions. They are permanently accessible on this page and referenced in the confirmation email sent to the Client after payment.

Article 4. Free trial

Plantsound offers a free trial of five (5) minutes of use, granted without registration and without payment details. The trial is intended to allow the User to verify, before any purchase, that the application works on their device, with their plant and in their lighting conditions.

The trial is limited to one occurrence per visitor over a rolling period of thirty (30) days. Attempting to circumvent this limit is a breach of these terms.

Article 5. Price, discount codes and payment

Access to Plantsound is sold as a single purchase of 94 € including all taxes. It is not a subscription: there is no automatic renewal and no recurring charge. The price applicable is the one displayed at the time of purchase.

Discount codes may be issued by the Publisher. A code is valid only within the limits set for it (period of validity, number of uses), and only one code may be applied to a purchase. The Publisher may withdraw a code at any time; a code already used for a completed purchase is not affected.

Payment is processed by SumUp, our payment service provider, on a page hosted by SumUp. Neurosound Ltd never sees, handles or stores your card details. The purchase is confirmed once SumUp reports the payment as completed.

Article 6. Scope of access

Access purchased entitles the Client to:

Access is personal. Sharing credentials with third parties, or any use allowing several distinct persons to benefit from a single purchase, is prohibited.

Article 7. Right of withdrawal

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and with Directive 2011/83/EU for consumers resident in the European Union, a consumer has a period of fourteen (14) days from the day the contract is concluded to withdraw without giving a reason.

Plantsound being digital content supplied immediately and not on a tangible medium, this right does not apply once performance has begun with the consumer's express prior consent and their acknowledgement that they thereby lose the right to withdraw. Access to the application is opened immediately upon confirmation of payment.

Where such express consent has not been obtained, the consumer retains the right to withdraw within fourteen days and to obtain a refund. A request may be sent to support@neurosound.bio.

The five-minute free trial exists precisely so that the User may satisfy themselves, before paying, that the application works on their device.

Article 8. Technical requirements

Plantsound requires a device fitted with a camera, a recent web browser, and an internet connection. Access to the camera must be granted by the User; without it, the application cannot function. The application also downloads a recognition model and its execution engine, approximately 43 MB in total, on first use.

Neurosound Ltd is bound by a best-efforts obligation. It cannot guarantee that Plantsound will operate on every device, every browser version or every network, nor that recognition will succeed on every plant and in all lighting conditions. The free trial allows these points to be verified before purchase.

Article 9. Obligations of the User

The User undertakes to:

Article 10. Liability

The liability of Neurosound Ltd may only be engaged up to the total amount paid by the Client. It excludes any indirect, incidental or consequential damage, including loss of data, loss of profit or loss of opportunity.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

Article 11. Duration and termination

Access being a single purchase, there is no subscription to terminate and no recurring billing to end. The Client may at any time request the deletion of their account and of the associated personal data, under the conditions set out in the Privacy Policy; such deletion ends access to the application.

Neurosound Ltd may withdraw access without notice, and without refund, in the event of a serious breach of these terms, in particular the sharing of credentials or an attempt to circumvent access control.

Article 12. Evidence

The parties agree that electronic records (connection timestamps, purchase references, payment confirmations issued by SumUp, opening of sessions) constitute admissible evidence between them as to the existence, content and performance of the contract.

Article 13. Amendments

Neurosound Ltd may amend these terms. The version applicable to a purchase is the one in force on the date of that purchase. Significant changes are notified by email or by a notice within the application.

Article 14. Applicable law and disputes

These terms are governed by the laws of England and Wales. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action; a request may be sent to support+legal@neurosound.bio.

Failing agreement, the courts of England and Wales have jurisdiction. Consumers resident in the European Union or elsewhere may also bring proceedings before the courts of their own country of residence where mandatory local consumer protection law so provides.

3. Privacy Policy

The essential point first

The images from your camera never leave your device. The recognition model is downloaded once and runs entirely in your browser. No photograph, no video, no frame is transmitted to our servers or to any third party. The same applies to the audio and MIDI files you record: they are produced in your browser and saved by you, and are never uploaded.

We sell no data. Advertising measurement with Meta is described in the cookies section below, including optional purchase reporting. Data may be disclosed to a competent authority upon a lawful request.

5. International transfers

Our servers are located in the United States (see the Legal Notice for the exact address). Where a transfer outside the United Kingdom or the European Economic Area takes place, it is carried out under an appropriate safeguard within the meaning of Chapter V of the UK GDPR and of the EU GDPR: the UK Extension to the EU-U.S. Data Privacy Framework, Standard Contractual Clauses, or the UK International Data Transfer Addendum. A copy may be requested by email.

6. Retention

7. Your rights

Under the UK GDPR and the EU GDPR you have the right of access, rectification, erasure, objection, restriction of processing, and portability, as well as the right to withdraw your consent at any time without affecting the lawfulness of processing carried out beforehand.

To exercise these rights, write to support@neurosound.bio from the address associated with your access. Please note that erasure of your account ends your access to the application, and that a new purchase would then be required.

You also have the right to lodge a complaint with the Information Commissioner's Office (ico.org.uk) or with the supervisory authority of your country of residence.

8. Security

Access to the site and to the application is served over HTTPS. Passwords are stored as hashes only. The data files are placed outside the web root and additionally protected against direct access. Sign-in attempts are throttled.

9. Automated decision-making

We make no decision producing legal effects concerning you, or significantly affecting you, on the basis of automated processing alone. The recognition model identifies a botanical family in order to choose a musical profile; it produces no decision about you.

4. Cookies and Local Storage

The application itself uses one cookie, and it is strictly necessary for the service you have requested. It carries no advertising cookie and no analytics cookie. Under the UK Privacy and Electronic Communications Regulations and Article 5(3) of the ePrivacy Directive, consent is not required for storage strictly necessary to provide a service explicitly requested by the user.

The presentation pages carry one advertising cookie, and it is active by default. On plantsound.fr we use the Meta (Facebook) pixel to measure how well our advertising works and to reach people whom Plantsound might interest. It loads when the page opens. You may object at any time from the link below; your choice is then kept on that device and the pixel does not load again. Switching it off does not erase what Meta has already recorded: to remove that, use your browser's site-data controls for facebook.com.

Cookies

NamePurposeRetentionType
ps_acces Keeps you signed in so that you do not have to identify yourself at each visit. Contains your email address and a cryptographic signature preventing any modification 180 days Strictly necessary
_fbp (and _fbc) Set by the Meta pixel on the presentation pages. Lets Meta measure the results of our advertising and build audiences. Set by Meta Platforms Ireland Ltd, who act as controller for this processing under their own policy 90 days Advertising, active by default

The pixel reports that a page was opened and that a button was clicked. It never sends your name, your email address or anything you type. It is present on the French and English presentation pages only: the application itself does not contain it.

Local storage

The application also stores a few preferences in your browser's local storage. These are not cookies: they are never transmitted to our servers, and they remain on your device.

KeyContent
plantsound.langueYour choice of language for the model labels
plantsound.diapasonYour chosen reference frequency
plantsound.lieuThe place used for the weather, if you have set one
plantsound.meteoThe last weather reading, so that it can be displayed before the network answers

Your browser also keeps the recognition model in its cache, so that it does not have to be downloaded again at each visit. Clearing your browser's site data removes all of the above; the application will then start afresh.

Third-party embeds

The presentation page includes a video hosted by Vimeo and a support chat widget. These services may place their own cookies when they load, under their own policies. The Plantsound application itself contains neither of them.

Managing cookies

You may configure your browser to refuse cookies at any time. Refusing ps_acces does not prevent the application from working, but you will have to sign in again at each visit.

Purchase measurement with Meta

The optional, unchecked box in the purchase form allows you to authorise sending a confirmed purchase to Meta for advertising measurement and optimisation. Declining does not affect payment or access. With your authorisation we send the amount, currency, purchase time and order identifier, a SHA-256 hash of your normalised email address, your IP address and browser user agent, and available Facebook click/browser identifiers. Hashing does not make this data anonymous. The application does not load the Meta pixel for this feature.

Advertising identifiers may be transferred from the presentation page in the URL fragment and kept in the application's session storage. Their use for a purchase requires the optional authorisation above. A recorded objection on either page prevents this use. Attribution data is removed from the delivery queue after successful delivery; unsuccessful or unpaid records retain it for up to 30 days while awaiting payment, or seven days after a verified purchase, provided the scheduled maintenance job is running. A minimal delivery record is retained to prevent duplicates. Closing the tab clears its session storage. To request removal of queued data, contact the publisher using the contact details on this page. Data already delivered is subject to Meta's own privacy controls.

Advertising cookie

The Meta pixel is active by default on the presentation pages. To object: open the advertising setting and switch it off. Your choice is kept on that device, and the pixel will not load again. It removes nothing Meta has already recorded; for that, use your browser's site-data controls for facebook.com.
